Uncontested Divorce FAQ
Texas requires a 60 day waiting period. On the 61st day, we go to court and get your decree signed and granted by the court.
If the divorce is uncontested ONLY one of the parties has to go to court with me to get your uncontested divorce approved (granted) by the judge. The other spouse can sign a waiver and sign the agreed divorce documents, and not need to appear in court. As soon as I get your documents approved by the court, I will email you a signed copy of the decree.
We charge a flat fee for uncontested divorces INCLUDING ATTORNEY APPEARANCE as follows:
$400. Uncontested divorce, no children, no marital property, no marital debt: Includes preparing and filing your divorce documents (not the filing fee) and attorney appearance in court for you.
$550. Uncontested divorce with children and property, with Texas standard custody and visitation schedules and child support
$650. Uncontested divorce with children and property, with Custom non-standard custody and visitation schedules, with or without child support.
We file your divorce, we go to the hearing with you. You don’t do anything but give us the information by email, fax, text or you are welcome to visit us at our office.
